Terms of use
Last updated 15 October 2026
These terms are an agreement between you and Black Ops Solutions IT Pty Ltd, an Australian company trading as Brioday ("we", "us", "our"). They cover your use of Brioday: the website and web app at brioday.app, the Android app, and the features and services in them (together, "the service"). How we handle your personal information is set out in our privacy policy, which is part of these terms.
The short version (the full terms below are what count):
- One person per account, and one account per person. Don't share your account or make extra ones.
- Use the AI features fairly, as a person, within your plan's allowance. No scripts, scraping or tricks.
- Don't abuse other people, and don't try to break, probe or overload the service. Report security problems to us.
- Brioday gives general fitness and nutrition information, not medical advice. AI estimates and allergen flags can be wrong.
- Premium renews until you cancel. Your rights under the Australian Consumer Law always apply.
- We can suspend or close accounts that break these terms. You can delete your account at any time.

1. About these terms
By creating an account, or by using the service without one, you agree to these terms. If you don't agree, please don't use the service. If you use Brioday on behalf of a business, such as a gym running a challenge, you agree to these terms for that business and confirm you're allowed to.
2. Changes to these terms
We may update these terms as Brioday changes or the law requires. We'll update the date at the top, and if a change is significant we'll tell you in the app or by email before it takes effect. If a change is to your detriment, we'll give you at least 30 days' notice; if you don't accept it, you can stop using the service and cancel any Premium plan, and we'll refund the unused part of a period you've paid for. Continuing to use the service after a change takes effect means you accept it.
3. Who can use Brioday
You must be at least 16 years old, or older if the law where you live sets a higher age for using online services without a parent's consent. If you're under 18, you must have a parent's or guardian's permission, and they're responsible for your use of the service. You can't use Brioday if we've previously closed your account for breaking these terms, unless we've agreed in writing.
4. Your account
You can use much of Brioday without an account. If you create one:
- Give us accurate information, and keep your email address up to date so we can reach you.
- Keep your password and any sign-in codes secret, and keep your devices secure. You're responsible for what happens under your account unless it happens because of our failure.
- Tell us straight away at [email protected] if you think someone else has used your account.
- Choose names and photos (your name, challenge names and branding) that you're entitled to use and that aren't offensive or misleading.
5. No sharing, one account each
- One person per account. An account, and any Premium plan on it, is for one person. Don't share your sign-in with anyone else, and don't let anyone else use your account, including family members, clients or gym members.
- One account per person. Don't create or use more than one account to get extra AI look-ups or allowance, extra free trials or offers, an advantage in challenges, or to get around a limit, a block or a suspension.
- We may treat accounts used by the same person, device or network in these ways as one account, and act on them together.
6. Acceptable use
When you use Brioday, you must not:
- harass, bully, threaten, abuse or discriminate against anyone, including other people in a challenge;
- use names, photos, challenge names or branding that are offensive, sexual, hateful, violent, or that infringe someone else's rights;
- impersonate any person, business or gym, or suggest you're connected with one when you're not;
- upload photos of other people without their permission;
- cheat in challenges, for example by logging workouts you didn't do to win a prize;
- use the service for anything unlawful, fraudulent or harmful, or to help someone else do so;
- sell, rent or resell access to the service or any part of it, or use it to run a competing service.
7. Fair use of AI features
Brioday's AI features (such as meal, supplement and exercise look-ups and form checks) cost us money every time they're used, so they come with a daily allowance that depends on your plan. To keep them working well for everyone:
- Use them yourself, through the Brioday app, for your own training and nutrition.
- Don't use scripts, bots, automation or other software to send requests, and don't scrape or bulk-collect results.
- Don't try to get around your allowance or our rate limits, for example with extra accounts, shared accounts or changed requests.
- Don't try to make the AI do something other than its job, reveal its instructions or misbehave ("prompt injection"), or send content that's unrelated, unlawful or harmful.
- Don't resell, republish in bulk or build a product on AI results from Brioday.
We monitor use of the AI features to keep them fair and secure, as described in our privacy policy. If use looks automated, abusive or far beyond what a person would normally need, we may slow it down, pause the AI features on that account, or suspend the account.
8. Security and testing
You must not, and must not try to:
- break, disrupt, overload or slow down the service, or flood it with requests;
- probe, scan or test the service for vulnerabilities, or get past any security, rate limit or access control;
- access accounts, data or systems that aren't yours;
- copy, decompile, reverse engineer or modify the app, except as the law allows;
- upload viruses, malware or anything designed to cause harm.
If you find a security problem, please tell us at [email protected] and give us a reasonable time to fix it before telling anyone else. We welcome good-faith reports, and we won't act against anyone who reports a problem responsibly and doesn't access, change or keep other people's data.
9. Health and fitness information
Brioday provides general information to help you train and eat well. It isn't medical, dietary, physiotherapy or other professional advice, and it doesn't replace advice from a qualified professional who knows your situation.
- Talk to a doctor before starting a new exercise program or diet, particularly if you're pregnant, injured, have a health condition or haven't exercised for a while.
- Plans, weights, targets, technique tips and form-check feedback are suggestions. Use weights you can handle safely, use a spotter or safety equipment where needed, and stop if you feel pain, dizziness or shortness of breath.
- Calorie, protein and other targets are estimates for an average person, not a prescription for you.
- In an emergency, call 000 (or your local emergency number).
You take part in exercise and make decisions about your diet and health at your own risk, subject to section 17.
10. AI, nutrition and allergen estimates
AI look-ups, barcode look-ups and nutrition figures are estimates. They can be wrong, for example about a food's amount, ingredients, nutrients or what a machine is.
- Check what Brioday shows you, and correct anything that's wrong.
- Allergen, intolerance and "things to avoid" flags are a guide only. They can miss an ingredient or flag one that isn't there. Always read the label, ask when eating out, and never rely on Brioday to manage a serious allergy or medical condition.
- Product information from third parties (such as Open Food Facts) is theirs, and may be out of date.
11. Your content
What you put into Brioday (your workouts, food, body data, notes, photos, challenge names and branding) stays yours. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process and display it only as needed to run the service for you and the people you choose to share with: for example, syncing it to your devices, sending it to an AI provider when you ask for a look-up, and showing your challenge name and progress to people in that challenge. This licence ends when your content is deleted, except for copies in backups for a short time, as our privacy policy explains. You confirm you have the right to give us this licence for content you upload, including photos and logos.
12. Our content and the app
The service, including the app, its design, plans, exercise information, text and the Brioday name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the service for your own purposes, in line with these terms. Other names and trade marks mentioned in Brioday belong to their owners.
13. Premium plans and payments
- Plans. Brioday is free to use. Premium plans unlock the AI features and give a bigger daily allowance. What each plan includes and costs is shown in the app before you buy.
- Payment. Payments are processed by Stripe, and your card details go to Stripe, not us. Prices are in Australian dollars unless shown otherwise.
- Renewal. A plan renews automatically at the end of each period, and you'll be charged the then-current price, until you cancel.
- Cancelling. You can cancel at any time in the app (Me › Manage subscription). You'll keep Premium until the end of the period you've paid for, and won't be charged again.
- Refunds. Except where the law requires (see section 17) or where we say so in these terms, payments aren't refundable for part periods or unused allowance.
- Price changes. We may change prices. We'll tell you at least 30 days before a new price applies to your plan, and you can cancel before then.
- Failed payments. If a payment fails, we may move your account to the free plan until it's paid.
- App stores. If you buy through an app store, its terms for payments, renewals and refunds apply to that purchase.
- Offers. Any free look-ups, trials or offers are one per person, and can end at any time for new sign-ups.
14. Suspension, closing and deleting accounts
We may suspend or close your account, or block a device from using the service, if we reasonably believe you've broken these terms (including sections 5 to 8), used the service fraudulently or unlawfully, put other people or the service at risk, or if the law requires it. Where it's reasonable, we'll tell you why and give you a chance to fix the problem first; we may act without notice where there's a risk of harm, abuse or loss, or if a breach is serious or repeated.
- While an account is suspended, you can't sign in, sync, use AI features or take part in challenges with it. Its data is kept, and what's on your phone stays there.
- We may queue a suspended account for deletion. A queued account and everything in it is deleted 7 days later, unless we reverse the suspension.
- If we close your account because you broke these terms, you aren't entitled to a refund of fees already paid, except where the law requires one.
- If you think we've got it wrong, email [email protected] from the address on the account. We'll review it and reply.
- You can stop using Brioday and delete your account at any time. How to, and what's deleted, is on Delete your Brioday account.
Sections 9, 10, 11 (for content already shared), 17, 18, 19 and 20 continue after an account is closed.
15. Availability and changes
We work to keep Brioday available and your data safe, but we can't promise the service will always be available, error-free or uninterrupted, for example during maintenance or problems with networks and providers. Brioday saves what you log on your phone first, and syncs it when it can.
We may add, change or remove features. If we remove a paid feature that's a main reason for your plan, we'll tell you and refund the unused part of the period. Features marked as beta or preview may change, be removed or not work as expected.
16. Other services
Brioday works with other services, such as AI providers, Open Food Facts, Stripe, Google sign-in, Health Connect, YouTube how-to links and push notification services. Your use of them may also be subject to their own terms. We aren't responsible for content or services we don't control, but we choose providers carefully, and our privacy policy lists what each one receives.
17. Our liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that can't be excluded.
Subject to that, and to the extent the law allows:
- we're not liable for any indirect or consequential loss, or for loss of data, profits or opportunity, arising from your use of the service;
- we're not liable for loss caused by your breach of these terms, by relying on estimates or information against sections 9 and 10, or by events beyond our reasonable control;
- our total liability to you for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or A$100 if you haven't paid us anything.
Our liability is reduced to the extent that you caused or contributed to the loss.
18. Your responsibility to us
You're responsible for, and agree to make good, any loss, damage or reasonable costs (including reasonable legal costs) we suffer as a result of your breach of sections 5 to 8, your unlawful use of the service, or a claim that content you uploaded infringes someone's rights, except to the extent the loss was caused by us.
19. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them. If you live outside Australia, you may also have rights under the law where you live that these terms can't change.
20. General
- The whole agreement. These terms and our privacy policy are the whole agreement between you and us about the service.
- If part doesn't apply. If any part of these terms is invalid or can't be enforced, it's read down or removed only as far as needed, and the rest continues.
- No waiver. If we don't enforce a right straight away, we haven't given it up.
- Transfer. You can't transfer your account or these terms. We may transfer them to a company that takes over Brioday, and we'll tell you if we do; your rights won't be reduced as a result.
- Notices. We'll send notices to the email address on your account or show them in the app. You can send notices to [email protected].
